Upon being granted an absolute divorce, certain marital rights will be extinguished, including spouse’s right to share in the other spouse’s estate. In North Carolina, plaintiffs may be granted an absolute divorce if they can prove one of two things: 1) that the spouses have been living separately for at least one year and either spouse has been resident of the state for at least six months, or 2) that the spouses have been living apart for at least three years due to incurable insanity. Divorce of any kind can be complex, confusing, and emotionally-demanding process. Our experienced Asheville attorneys handle all aspects of family law cases, from mediation and settlement to litigation and enforcement.
